Terms of Service

These terms govern your use of the international tender qualification service offered through ihaleatlas.com (the "Service"). By using the Service you confirm that you have read, understood and accepted these terms.

1. Definitions

• "Service": the international public tender qualification process delivered through ihaleatlas.com — collecting opportunities from official sources, filtering them against the user's scope profile and delivering them as a written decision note.

• "User": any natural or legal person who visits the Service for free, or uses it through a paid subscription or one-time request.

• "Customer": a User with an active Standard or Plus subscription, or who has purchased a Deep Evaluation.

• "Decision Note" / "Report": the written deliverable prepared on a weekly basis under the Service, containing a single fit label per tender (eligible, probable, unclear, critical-missing, not eligible) along with the underlying rationale.

2. Scope of the Service

İhaleAtlas screens, filters and converts tender notices from eight official sources (TED, EBRD, World Bank, UNGM, ADB, AfDB, IsDB, IDB) into a weekly decision note, within the scope profile defined in writing by the Customer.

The Service is not a tender listing or intermediary service; it does not establish any agency relationship between the Customer and the official tender authorities.

The decision note is evaluation material prepared for the Customer, who remains the decision-maker. It is not legal advice, financial advice or a bid-writing service.

3. Account, Authentication and Access

Access to the customer area is granted through one-time codes sent by email (no password is stored).

The Customer is responsible for the security of the email address used to access the account. Actions performed via that email are deemed to have been performed by the Customer unless the contrary is proven.

If unauthorised access is suspected, the Customer must notify desk@ihaleatlas.com immediately.

4. Fees, Subscription and Payment

Standard and Plus plans are offered against a monthly subscription fee. The subscription starts on the purchase date and renews on the same date each month. Renewal fees are charged for any period in which the subscription has not been cancelled.

Deep Evaluation is offered against a one-time fee. No fee is charged before the work scope is clarified in writing.

Payments are processed through the available infrastructure providers (Shopier for customers in Turkey; Lemon Squeezy for international customers, after the store is approved). Card details are not stored on İhaleAtlas.

Tax and invoicing: For TR customers, transactions are handled under Turkish tax legislation. For sales processed through Lemon Squeezy, Lemon Squeezy acts as Merchant of Record and assumes the relevant tax/invoicing obligations.

5. Cancellation and Refunds

Cancellation of a subscription takes effect at the end of the current billing period. Detailed cancellation and refund rules are set out in a separate policy; see the Refund & Cancellation Policy page for details.

6. Customer Obligations

The Customer is responsible for providing accurate and current information when defining the scope profile.

The Customer uses the delivered decision note solely for its own commercial decisions; it shall not be redistributed to third parties, resold or published in public channels.

The Customer agrees not to use the Service for unlawful purposes, in a way that infringes the rights of others, or with automated tools that disrupt the operation of the Service.

7. Prohibited Use

The following uses are expressly prohibited and may result in suspension or termination of the account:

• Overloading the Service through automated tooling (DDoS, scraping, brute-force, etc.).

• Attempting to bypass the Service's security mechanisms or probe for vulnerabilities outside any authorised disclosure process.

• Attempting to access another user's account or impersonating another user.

• Reverse engineering, unauthorised acquisition or copying of the source code.

8. Intellectual Property

The decision note text, taxonomy, classification and evaluation methodology produced under the Service are the intellectual property of İhaleAtlas. The Customer is granted a non-exclusive, non-transferable right of internal use for the period covered by paid fees.

Official tender notices remain the content of their respective public authorities (TED, EBRD, etc.); İhaleAtlas claims no ownership over them. Source attribution is preserved within the decision note.

9. Disclaimer — Not Legal or Financial Advice

The decision note delivered under the Service is written evaluation material to support the Customer's tender participation decisions; it is not legal advice, financial advice, investment advice or a bid-writing service.

The fit label (eligible, probable, unclear, critical-missing, not eligible) is assigned according to İhaleAtlas's methodology; it does not determine the final eligibility decision of the tender authority.

The Customer remains responsible for obtaining advice from its own professional advisors (lawyers, accountants, etc.) for actual tender participation, bid preparation, contract negotiation and compliance with legal obligations.

10. Disclaimer of Warranties

The Service is provided "as is". No guarantee is given that any specific tender will be won, that any candidate will be a fit for the Customer, or that data from official sources will at all times be up to date and accurate.

İhaleAtlas's liability for decision impacts caused by delays, gaps or inaccuracies in data from official sources is limited to the subscription fees paid.

11. Limitation of Liability

Except in cases of direct provable fault, İhaleAtlas shall not be liable for indirect, incidental, special or consequential damages (lost profits, lost opportunities, reputational damage, etc.) arising out of the use of the Service.

In any event, the total liability of İhaleAtlas is capped at the amount paid by the relevant Customer for the Service in the 12 months preceding the event.

12. Suspension and Termination

İhaleAtlas may suspend or terminate an account in cases of prohibited use, payment failure, or suspected misuse of the Service.

On termination, the Customer is entitled to a refund for any paid period that has not yet been delivered (except where termination is due to prohibited use).

13. Changes

These terms may be updated from time to time. Active Customers will be notified by email of material changes.

Updated terms enter into force 30 days after publication. During this period the Customer may cancel the subscription; absent cancellation, the new terms are deemed accepted.

14. Governing Law and Dispute Resolution

This agreement is governed by the laws of the Republic of Türkiye.

Disputes shall first be addressed through written negotiation between the parties. Failing agreement, consumer disputes are subject to the Turkish Consumer Arbitration Boards and Consumer Courts; non-consumer disputes are subject to the courts and enforcement offices of Istanbul (Çağlayan) Central Courthouse.
